"Capital error ?" Texan who died in prison cleared of rape conviction

(CNN) -- A Texas district court judge Friday reversed the conviction of a man who died in prison nearly a decade ago, almost two decades into a prison sentence for a rape he swore he did not commit, CNN affiliate KXAN reported.

Timothy Cole was convicted and sentenced to 25 years in prison for the 1985 rape of 20-year-old Michele Mallin. He maintained his innocence, but it was not confirmed by DNA until years after his 1999 death, when another inmate confessed to the rape.

In the courtroom of Judge Charlie Baird Friday afternoon, Mallin, now 44, faced Jerry Johnson, the man who confessed to the rape.

"What you did to me, you had no right to do," she told him angrily, according to Austin's KXAN. "You've got no right to do that to any woman. I am the one with the power now, buddy."

Cole's family also addressed Johnson.

"He'll never have the chance to have children," Cole's mother, Ruby Session, said. "I want you to know he was a fine young man."

Johnson has been in prison since 1985 on two convictions for aggravated sexual assault, according to the Texas Department of Corrections. He was given a life sentence for the rape of a 15-year-old girl, and a jury later tacked on a 99-year sentence for another rape, according to the Lubbock, Texas, Avalanche-Journal. He cannot be charged with the Mallin case, as the statute of limitations has expired.

Johnson also spoke Friday.

"I am responsible," he said. "I say I am truly sorry."

Then a student at Texas Tech University in Lubbock, Mallin was walking to her car, intending to move it to another parking lot, when a man approached her asking about jumper cables, she said. In a matter of seconds, he put her in a choke hold and held a knife to her neck. He forced himself into her car and drove her to the outskirts of town, where he raped her.

The next day, police investigators showed Mallin pictures of possible suspects. She chose a picture of Cole and said he was her attacker. She later identified him in a physical lineup, according to the Innocence Project of Texas.

Congress to DEA: Reconsider Monopoly on Medical Marijuana Research

Washington, DC -- Sixteen Members of Congress issued a letter yesterday to newly-seated Attorney General Eric Holder urging the Drug Enforcement Administration (DEA) to act "swiftly to amend or withdraw" an order that significantly curtails medical marijuana research in the United States. For more than forty years, the federal government has held a unique monopoly on the cultivation of marijuana for medical research, significantly impeding studies on the therapeutic qualities of medical marijuana and the ability to bring it to market. In February of 2007, DEA Administrative Law Judge Mary Ellen Bittner ruled to end that monopoly by claiming that expanded medical marijuana research was "in the public interest."

The Congressional letter sent to Attorney General Holder was authored by John Olver (D-MA) and states in part:

Since 2001, Prof. Lyle Craker, an experienced botanist of medicinal plants and soils, has been struggling to obtain a DEA license for a privately-funded facility located at the University of Massachusetts to grow cannabis (marijuana) exclusively for FDA-approved research protocols designed to evaluate its potential medical value. Forty-five members of the House of Representatives and Senators Edward Kennedy and John Kerry, as well as a broad range of scientific, medical and public health organizations including the Lymphoma Foundation of America, the National Association for Public Health Policy, and the Multiple Sclerosis Foundation have all written to DEA in support of Professor Craker's efforts.

Looking for your vitamins? Look to your vegetables.

Many people believe that when you transition to a vegan diet you are putting yourself at risk for deficiency for a host of vitamins. This couldn’t be further from the truth. In fact, meat and dairy products only have a select few vitamins and minerals, no fiber, very few carbohydrates which are essential for brain function (none in meat), little to no water and no antioxidants.

In stark contrast plant foods (fruits, vegetables, legumes, nuts, seeds and grains) are high in a vast array of vitamins and minerals, high in fiber, rich in carbohydrates, water rich and are packed with an assortment of antioxidants. To put it simply plant foods are more nutrient dense than animal. Nutrient density means that a food provides a large amount of nutrients relative to the number of calories it contains. The higher the level of nutrients and the fewer the number of calories the more nutrient dense a food is.

There are literally thousands of edible plant foods and I’ve randomly picked out 5 of my personal favorites to compare against chicken breast and milk.

As you can see from the chart above different foods are rich in different vitamins & minerals. Collard Greens are high in calcium, iron, Niacin, folate and vitamin A; Quinoa is high in protein, iron and zinc; blueberries are rich in antioxidants, almonds are high protein, calcium, iron, zinc, EFA’s and vitamin E; and black beans are high in protein, iron, zinc and folate. All of them have all the other essential vitamins and minerals that you need in modest amounts so that when you eat a balanced, varied diet you get everything you need. The only exception to the rule is vitamin D and vitamin B12. Vitamin D is not abundant in any food. Sure you can get a bit from fish but overall meat, dairy and plant based foods are so low in vitamin D that there’s not even a column for them in the USDA nutrient database. Vitamin D is a fat soluble vitamin that is activated when the sun hits our skin. 15-30 minutes of sunlight will give you the adequate amount you need. Since many people spend most of their time in doors or slathered in sun block a lot of physicians are now recommending you take a vitamin D supplement. Your doctor can run a simple blood test to see if you are deficient in vitamin D. After all the hype over vitamin D deficiency and the purported problem with African-American’s not being able to get adequate amounts of vitamin D due to darker skin color I was surprised that, after taking this blood test, I am not deficient in Vitamin D and my levels were well within the normal range. I highly recommend getting this test just so you know where you stand. One more word on Vitamin D. The dairy industry has been pushing the need to drink milk to get this vital nutrient. However, milk does not naturally contain vitamin D, it is fortified with vitamin D. So you would be better off drinking calcium and vitamin D fortified orange juice (which is more nutrient dense than cow’s milk) or simply taking a vitamin D supplement. Lastly, as many vegans already know there are no longer any reliable plant based sources of vitamin B12. Many experts recommend taking a vitamin B12 supplement.

[NOTE: What the authors mean by "no longer" any plant sources of Vitamin b12 is that pesticides have killed the bacteria that are b12 that humans used to be able to get on plants. So, technically, before GMOs and pesticides, we could get b12 from plants as well but it is advisable to take a supplement to be safe. -AL]
